What is conveyancing in Queensland?

The legal procedure of transferring ownership of real property from one person to another is called conveyancing. This includes contract preparation and review, searches, conditions and disclosures, key dates and timeframes and registration of the transfer with Titles Queensland in Queensland.


The Property Law Act 2023 (Qld), which came into effect on 1 August 2025, introduced a mandatory seller disclosure regime that has changed how every residential property transaction in this state begins.

How much does conveyancing cost in Brisbane?

For standard residential conveyancing, A.L.F Lawyers charges on a fixed fee basis. This means our legal fees are agreed in writing before you engage us, with no hourly billing for the conveyancing process itself.


Conveyancing costs in Queensland generally fall into three components. The first is legal fees, which are fixed for a standard transaction. The second is statutory fees, including the Titles Queensland registration fee and, for buyers, stamp duty. The third is disbursements, which cover the cost of the searches required to complete due diligence.

 

When choosing a conveyancer in Brisbane, it is important to consider both the legal fees and the additional costs involved in completing the transaction.

TIMEFRAMES

How long does conveyancing take in Queensland?

A standard residential settlement in Queensland typically occurs 30 to 60 days after the contract date, with the exact period agreed between the parties in the contract itself. During that period there are several critical dates: the cooling-off period for buyers, the finance clause date (if applicable), the building and pest inspection date (if applicable), and any other special condition dates set by the parties.


Where a transaction is unconditional, settlement can occur in as little as 14 days. More complex transactions, particularly those involving off-the-plan contracts or commercial property, can take significantly longer.


Most standard REIQ contracts also include a settlement extension provision, which gives either party a safety net of up to 5 business days to extend settlement where needed. We cover this in more detail on our buyer and seller service pages.

WHO PAYS WHAT

Who pays the conveyancing fees: buyer or seller?

Each party pays their own legal fees. The buyer engages and pays their own conveyancer or solicitor, and the seller does the same. Buyers also typically pay for the searches conducted on their behalf and the statutory transfer registration fee. Sellers pay the costs associated with discharging their mortgage and producing the seller disclosure documentation now required under the Property Law Act 2023 (Qld).

When should I engage a conveyancing lawyer?
Before you sign the contract, not after. Once a contract is signed, your options for negotiating terms or walking away are limited and often costly. The most important thing you can do to protect yourself during a property transaction is to have the contract looked at by any conveyancing solicitors.
While there is no legal obligation to use a solicitor, there are enforceable contract terms, statutory disclosure requirements, time-critical conditions and correct registration of title with Titles Queensland involved in conveyancing in Queensland. Working with experienced conveyancing solicitors can help ensure these requirements are properly managed.
The cooling-off period, the finance clause, the building and pest inspection condition, the special conditions, the deposit conditions and the seller disclosure papers that are now required under the Property Law Act 2023 (Qld). Both establish rights and obligations which may impact your ability to leave, renegotiate or recover the deposit.
The standard searches include title searches, survey plans, council searches, water authority, land tax and body corporate searches where applicable depending on the property. Where the property is located in an area with specific risks such as flooding, asbestos or contamination, additional searches may be appropriate.

What happens if a seller fails to disclose something material?
The Property Law Act 2023 (Qld) requires a seller to provide a Form 2 Seller Disclosure Statement before the contract is signed. Where a seller fails to disclose, or discloses an inaccurate statement concerning, a material matter, the buyer may have a right to cancel the contract prior to settlement and damages.
